NCSwitch 4 End User License Agreement

DEFINITIONS

(a) "NCSwitch 4" or "the software" means both an application program used for changing PC settings and bundled documents currently marketed under the name "NCSwitch 4".

(b) "you" means an individual or an organization which uses the software.

(c) "we" or "us" means a copyright owner of the software, SPIRALWARE CO., LTD.

INTRODUCTION

In order to use the software, you must agree to this License Agreement.

LICENSE

You may use the software subject to your payment for a license key published by us.  However, for 30 days starting the time of using the software first, you may use the software without a license key only for evaluating purpose.

You can purchase a license key from our website: http://spiralware.jp/ .

A license key is required per your physical device (PC, tablet and so on).

You shall not register same license key on two or more devices.

However, only if your device became unusable, you may register same license key of the device

with another device.

A license key is valid for the current major version of the software (4.x), and remains valid for all updates to but not including the next major version.

A license key is non-exclusive, revokable and non-transferrable.

LIMITED WARRANTY

We warrant the software provides functions and features described at our website and/or bundled document of this software.

We have taken all reasonable steps to keep the software free of viruses, spyware, "back door" entrances, or any other harmful code.

To the extent permitted by applicable law, we disclaim any implied warranty of marchantability of fitness for a purticular purpose.

LIMITATION OF LIABILITY

Your exclusive remedy under the above LIMITED WARRANTY, or otherwise in connection with the EULA and/or your use or attempted use of the software, shall be, at our option, either a full refund of any license fee paid or correction of the defective software.

To the extent permitted by applicable law, we disclaim all liability for loss of profits, loss of revenue or loss of data, and

for any indirect consequential damages that arises under or in connection with this and/or your use or attempted use of the software.

GENERAL PROVISIONS

You may use the software subject to internal business purpose.

You may redistribute the software subject not to change any part of the software.

(Please contact us when you are going to redistribute the software to many unspecified persons in a magazine and so on.)

We retain ownership of copyright of the software.

This argeement will be governed by the laws of Japan and the Nagoya District Court in Japan shall have exclusive jurisdiction

in respect of any dispute or matter arising out of or in connection with it.
